New York Lawyers Protecting Grandparents' Rights to Visitation

Divorce or the death of a parent often has a negative impact on a child's relationship with his or her grandparents. Depending on parental choice or custodial and visitation arrangements, grandparents may experience a significant reduction in the amount of time they spend with their grandchildren.

Grandparents have specific rights in the state of New York. In some circumstances, it is possible for a grandparent to petition the court for custodial or visitation rights to their grandchildren.

Asserting Your Rights
Although parental wishes are strongly favored by the courts, grandparents may be able to seek court-ordered visitation or child custody rights regarding a minor grandchild. To do so, they must establish a sufficient existing relationship, beyond biological ties, with their grandchild. In cases where a parent has not allowed a bonded relationship to occur, a grandparent must demonstrate he or she made significant efforts. In the end, the court will make a determination based on the best interests of the child.
