New York has a statutory guideline formula for determining spousal support, also known as maintenance or alimony. It is important to remember that this formula is simply a guideline, and particularly in cases where the payor spouse’s income exceeds the statutory cap, various factors take on additional relevance.

Divorce Involving W-2 Earners

If you or your spouse earn money as an employee, you will have been given a copy of a document known as a Form W-2. These documents report the earnings of an individual, in totality, for an entire calendar year. Normal wages will be reported on the Form W-2 along with additional earnings like any tips or bonuses received during the calendar year. During the divorce process, you or your spouse may be required to provide your Form W-2. This allows your attorneys to properly tabulate the total earnings you were able to receive over the course of a calendar year and ensure that both parties are compensated as appropriately as possible.
